Terms of Service

1. Acceptance of Terms

By accessing our website at acebadminton.au or using our booking platform, you confirm that you have read, understood, and agree to these Terms of Service and our Privacy Policy. If you do not agree with any part of these terms, you must not use our services.

2. Eligibility

To create an account on our booking platform, you must be at least 16 years of age. If you are under 18, you confirm that you have obtained consent from a parent or legal guardian, who accepts these Terms on your behalf.

Our programs are open to participants of all ages. Junior programs (ages 7–12) and Teen programs (ages 13–17) require a parent or guardian to manage bookings and accept these Terms on behalf of the participant.

3. Class Bookings

Bookings are made through our online booking platform at acebadminton.au/book. By completing a booking, you agree to:

• Attend the booked session at the nominated venue and time
• Arrive on time and appropriately dressed for physical activity
• Follow all venue rules and coach instructions
• Notify us as soon as possible if you are unable to attend

4. Cancellation Policy

We understand that circumstances change. Our cancellation policy is as follows:

• Cancellations made more than 24 hours before the session start time: session credit issued
• Cancellations made within 24 hours of the session start time: no credit or refund
• No-shows (failure to attend without notice): no credit or refund
• In exceptional circumstances (medical emergency, etc.), please contact us directly — we will consider requests on a case-by-case basis

Ace Badminton reserves the right to cancel or reschedule sessions due to venue unavailability, insufficient enrolments, coach illness, or other circumstances beyond our control. In such cases, a full credit or alternative session will be offered.

5. Physical Activity — Assumption of Risk & Liability

You represent and warrant that:

• You are in satisfactory physical condition to participate in badminton training
• You are not aware of any medical condition that would make such participation unsafe
• You have consulted with a qualified medical professional if you have any concerns about your fitness to participate

To the maximum extent permitted by the Australian Consumer Law, Ace Badminton and Bosco Kwok are not liable for any personal injury, loss, or damage suffered by a participant during or arising from participation in any Ace Badminton program, except where such liability cannot be excluded by law.

6. Photography and Media Consent

Ace Badminton may take photographs and videos at sessions and events for use on our website, social media, and promotional materials. By participating in our programs, you consent to being photographed or filmed during sessions.

If you do not wish to be photographed or filmed, or do not consent on behalf of a minor, please notify us in writing at bkwo5253@gmail.com before attending your first session. We will respect your wishes.

7. Working With Children

The safety of children is our highest priority. All Ace Badminton coaches who work with participants under 18 years of age hold a current Working With Children Check (WWCC) clearance as required under the Child Protection (Working with Children) Act 2012 (NSW).

8. Acceptable Use of the Booking Platform

You agree not to:

• Use the booking platform for any unlawful purpose
• Attempt to gain unauthorised access to other users' accounts or data
• Share your account credentials with any other person
• Provide false or misleading information when creating an account or making a booking
• Interfere with or disrupt the operation of the platform

We reserve the right to suspend or terminate your account if you breach these terms.

9. Intellectual Property

All content on the Ace Badminton website — including text, images, logos, videos, and design — is the property of Ace Badminton (Bosco Kwok) and is protected by Australian copyright law. You may not reproduce, distribute, or use any content without our prior written permission.

10. Governing Law

These Terms of Service are governed by the laws of New South Wales, Australia. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts of New South Wales.

Nothing in these terms is intended to exclude, restrict, or modify any rights you may have under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)).

11. Changes to These Terms

We may update these Terms of Service from time to time. The effective date at the top of this page will be updated accordingly. Continued use of our services after changes are published constitutes your acceptance of the updated terms.
